Liability Waiver

PARTICIPATION AND ASSUMPTION OF RISK I confirm that I am the parent or legal guardian of the participating child and have authority to provide this consent. I understand that birthday parties, crafts, DIY and food-related activities, games, play, and use of the premises or equipment involve inherent risks, including slips, falls, minor injuries, allergic reactions, and contact with food, craft materials, equipment or other participants. I voluntarily permit my child to participate and accept the risks reasonably associated with these activities. RELEASE AND WAIVER In consideration of my child's participation, I agree, on my own behalf and, to the extent legally permitted, on behalf of my child, to release Creative Birthdays, its owners, employees, contractors and agents from claims arising from participation in activities or use of the premises, including claims arising from ordinary negligence, to the extent permitted by Ontario law. This waiver applies to personal injury, illness, property damage or other loss. Nothing in this agreement excludes liability that cannot lawfully be excluded or limited. PARENT/GUARDIAN RESPONSIBILITY I remain responsible for my child's supervision, behaviour, needs and safety unless Creative Birthdays has expressly agreed otherwise. I will inform staff of any medical condition, allergy, dietary restriction, behavioural concern or other information relevant to my child's safe participation. Creative Birthdays may limit or stop participation where reasonably necessary for the safety of my child or others. ALLERGIES AND MEDICAL CONDITIONS I have disclosed all known allergies, medical conditions and dietary or special requirements relevant to my child's participation. I understand that food and craft activities may involve exposure to allergens and that Creative Birthdays cannot guarantee an allergen-free environment. In an emergency, I authorize Creative Birthdays to contact emergency medical services and provide relevant information to emergency responders. I remain responsible for providing any medication or medical equipment my child may require. For severe or life-threatening allergies, Creative Birthdays may require a parent or responsible adult to remain present and may restrict participation in certain activities for safety reasons. PERSONAL PROPERTY Creative Birthdays is not responsible for lost, stolen or damaged personal belongings, except where liability cannot lawfully be excluded. PHOTO AND VIDEO CONSENT Photo and video consent is optional and separate from participation. Declining consent will not affect my child's ability to participate. Where consent is provided, Creative Birthdays may use approved photographs or recordings for its website, social media, advertising and promotional purposes in accordance with its privacy practices. PRIVACY I understand that Creative Birthdays may collect and use personal information necessary to manage bookings, events, safety, emergency contacts, allergies, customer service and related business operations. Personal information will be handled in accordance with applicable privacy requirements and Creative Birthdays' privacy practices. ACKNOWLEDGEMENT I confirm that the information I have provided is accurate and complete and that I will advise Creative Birthdays of any relevant changes. I have read and understood this agreement, understand that it affects certain legal rights, and voluntarily agree to its terms. This agreement is governed by the laws of Ontario. TERM This agreement applies to the identified event and, where permitted by Creative Birthdays, subsequent events attended by the same child for up to one year from the date signed. Creative Birthdays may require an updated waiver or consent where circumstances, activities or information change. ELECTRONIC ACCEPTANCE By signing electronically, I confirm that I have read, understood and agree to this Parent/Guardian Waiver, Release and Consent Agreement.
